혁신성장동력으로 충분한 가치가 있는 소프트웨어(이하 ‘SW’라 함)시장의 발전, 특히 공공SW시장의 새로운 성장동력을 발굴하기 위해서 규제가 완화되어야 한다는 주장이 제기됐다. 한국경제연구원(원장 권태신, 이하 한경연)은 '공공SW사업 대기업참여제한 제도의 평가와 시사점' 보고서를 통해 이같이 밝혔다.

◆공공SW시장, 2013년 이후 수익성 악화, 중소기업 수 감소
보고서는 2017~2021년 세계 SW시장은 연평균 4.4% 성장할 것으로 예상되지만, 국내 SW시장은 포화상태에 달하면서 2.5%로 저성장이 예상되며 이는 새로운 고성장 기업이 탄생할 수 없는 ‘생태계의 화석화’ 현상으로 보인다고 분석했다. 특히 신기술 투자ㆍ활용에 있어 주도적인 마중물 역할을 하고 있는 공공SW시장이 대기업참여제한 이후 상황이 악화되었다는 지적이다. 대기업참여제한 제도를 강화한 이후 공공SW사업에 주력하고 있는 중견기업들의 영업이익률(적자 또는 0.2~1.6%)이 전체 IT서비스기업의 평균 영업이익율(2016년 6.4%)보다 크게 낮은 점으로 보아 공공SW사업의 수익성이 악화된 것을 알 수 있고, 수익성이 악화되면서 기업의 참여 기피에 따른 유찰률이 증가하고 있다.

또한 임 부연구위원은 “공공SW시장에서 대기업을 규제함으로써 나타난 효과는 중소기업의 성장이나 수익성 증가보다는 시장경쟁구조가 왜곡됨으로써 동반되는 역차별과 함께 참여기업 모두가 경쟁력이 약화되는 결과로 이어지고 있다”고 주장했다. 특히, 대기업참여제한 후 중소기업의 수가 감소하는 부작용이 발생하였고, 중소기업의 보호ㆍ육성이라는 제도 목적을 충족하지 못했다는 주장이다.

그는 “국내 SW기업의 생태계가 화석화되어가는 심각한 상황에서, SW산업의 마중물이자 큰 영향력을 행사하는 공공SW사업마저 어려운 상황이므로 새로운 성장동력 또는 전환정책이 필요한 상황”이라고 지적했다. 공공SW사업 관련 대표적인 규제인 ‘공공SW사업 대기업참여제한 제도’의 완화를 통해서 역동적인 SW생태계로 전환시킬 필요가 있다는 것이다.

◆2015년 이후 전자정부 수출실적 반토막, 역동적 생태계 조성 필요
임동원 부연구위원은 “해외수출 측면에서도 대기업참여제한으로 수요자가 요구하는 유사사업 실적을 맞추지 못해서 제약받고 있고, 이에 따라 전자정부 수출도 급감했다”고 주장했다. 대기업참여제한 제도가 시행된 후 대기업 주도의 대형사업 수주가 급격히 감소하면서, 전자정부 수출실적은 2015년 5억 3,404만 달러로 최고점을 기록한 후 2016년(2억 6,945만 달러, △49.5%), 2017년(2억 3,610만 달러, △12.4%)로 하락세이며, 해외에서는 최근 3년의 유사사업 실적으로 평가하므로 2014년부터 국내 공공정보화사업을 하지 못한 대기업의 전자정부 해외구축실적이 2016년 이후 줄어들었고 전체 해외사업 수주도 감소한 것이라고 지적한 것이다.

그는 “국내 SW기업의 생태계가 화석화되어가는 심각한 상황에서, SW산업의 마중물이자 큰 영향력을 행사하는 공공SW사업마저 어려운 상황이므로 새로운 성장동력 또는 전환정책이 필요한 상황”이라고 지적했다. 공공SW사업 관련 대표적인 규제인 ‘공공SW사업 대기업참여제한 제도’의 완화를 통해서 역동적인 SW생태계로 전환시킬 필요가 있다는 것이다.

◆공공SW사업 시장참여 제한은 우리나라에만 있는 갈라파고스 규제
법적 또는 국제적 측면에서도 공공SW사업 관련 대표적인 규제정책인 대기업참여제한 제도가 법률 규정상 위헌의 소지가 있고 외국에 없는 규제이므로 완화될 필요가 있다고 설명했다. 임동원 부연구위원은 “대기업집단 소속기업을 일방적으로 시장에서 전면 퇴출하도록 하는 현행 제도는 과도한 규제수단을 사용한 것으로서 ‘방법의 적절성과 피해의 최소성’ 측면에서 헌법상 과잉금지원칙에 위반될 소지가 높다”고 언급하면서, “외국의 경우 공공SW사업 분야에 기업규모 및 특성에 따른 경쟁배제제도를 운영하고 있지 않다”고 주장했다.

◆신산업 분야에 한해서라도 대기업참여 전면 허용 필요
보고서는 대기업과 중소기업으로 구분한 공공SW정책은 혁신성장동력을 발굴하기에는 적합하지 않고 ‘혁신’과는 점점 멀어지고 있으므로 신산업 분야에 한해서라도 대기업 참여를 전면적으로 허용하는 것이 타당하다고 언급했다.

임동원 부연구위원은 “현재 신산업 분야 공공SW사업에 한해서 대기업의 참여가 허용되지만, 과학기술정보통신부의 심의 후 허용 방식이고 그 허용율이 50% 미만으로 낮아 사업추진 여부에 대한 불확실성이 큰 상황”이라고 지적하면서, “신산업 분야에 대해서라도 별도의 심의 절차 없이 대기업 참여를 전면적으로 또는 적극적으로 허용해준다면, 대기업이 국내 공공SW사업에서 확보한 레퍼런스를 가지고 해외에 진출할 수 있을 것이므로 4차 산업혁명 시대의 글로벌 경쟁력이 강화될 것”이라고 주장했다.

아울러 그는 “자본 및 사업추진력을 갖춘 대기업과 세부 기술력을 가진 중소기업 간의 컨소시엄을 통해서 보다 효율적인 공공SW사업 수행이 가능할 수 있고, 대기업과 중소기업과 동반성장할 수 있는 여건도 조성될 것”이라고 덧붙였다.

Some argued that regulations should be eased in order to find new growth engines in the software (hereinafter referred to as "SW") market, which is sufficiently valuable as an innovative growth engine, especially in order to find new growth engines. Kwon Tae-shin, president of the Korea Economic Research Institute (KERI), said in a report titled, "The Evaluation and Implications of the Restriction of Participation in the Public SW Business in Large Companies."

∘ Public SW market, worsening profitability since 2013 and decreasing the number of small and medium-sized enterprises
The report said that while the global SW market is expected to grow 4.4 percent annually between 2017 and 2021, the country's SW market is expected to grow at a low rate of 2.5 percent as it is saturated, which appears to be a "fossilization of the ecosystem" phenomenon where new high-growth companies cannot be created. In particular, it is pointed out that the situation has worsened since the public SW market, which plays a leading role in investment and utilization of new technologies, was restricted from participating in large companies. Given that the operating profit ratio (red or 0.2 to 1.6 percent) of small and medium-sized companies that are focusing on public SW projects is significantly lower than the average operating profit ratio of all IT service companies (6.4 percent in 2016), the profit margin of the public SW business is worsening, and that the profit margin of the public SW business is increasing due to the companies' reluctance to participate.

"The effect of regulating large companies in the public SW market has been the result of the weakening competitiveness of all participating companies, along with the reverse discrimination that accompanies the distorted market structure rather than the growth or profitability of small and medium-sized enterprises," said Lim. In particular, it is argued that the number of small and medium-sized enterprises decreased after the restriction on participation in large enterprises, and that the institutional purpose of protecting and nurturing small businesses was not met.

"In a serious situation where the ecosystem of SW companies in Korea is becoming fossilized, even public SW businesses, which are the mainstay of SW industries and wield great influence, are in need of new growth engines or conversion policies," he pointed out. They say that the government needs to shift to a dynamic SW ecosystem by easing the 'public SW business conglomerates participation restriction system,' a major regulation related to public SW projects.

〇 Need to create a dynamic ecosystem of e-government export performance after 2015
"In terms of overseas exports, we are also constrained by the failure to meet the performance of similar businesses demanded by our customers due to the restriction on participation in large companies, and the export of e-government plunged as a result," said Lim Dong-won, an associate researcher. As orders for large businesses led by large companies have decreased sharply since the system was implemented, e-government export performance hit a record high of $534.44 million in 2015 before falling to $269.45 million in 2016, 49.5 percent in 2017, $236.1 million, or 12.4 percent in 2017, and as overseas companies have been evaluating similar projects in the past three years, they have not been able to build public information projects since 2014.

∘ Restrictions on market participation of public SW businesses are limited to Galapagos in Korea only
The regulation on conglomerates' participation, which is a major regulatory policy related to public SW projects, is unconstitutional under the law and is not in a foreign country, so it needs to be eased," he said. "The current system, which requires companies belonging to large business groups to unilaterally withdraw from the market, uses excessive regulatory means and is highly likely to violate the rule of providing excessive subsidies under the Constitution in terms of the appropriateness of the method and the minimum amount of damage," said Lim Dong-won, an associate researcher at the institute, claiming that foreign companies do not operate a competitive exclusion system based on the size and characteristics of their businesses in the public SW business sector.

∘ Large companies should be allowed to participate in the new industry only
The report noted that public SW policies, divided between large and small businesses, are not suitable for finding innovative growth engines and are becoming increasingly "innovative," so it is reasonable to allow full participation in even new industries.

"Although large companies are allowed to participate in public SW projects in new industries only, they are allowed to participate in large companies after deliberation by the Ministry of Science, ICT and Information and Communication and are highly uncertain whether or not they will proceed with the project," said Lim Dong-won, an associate researcher at the institute. "If large companies are allowed to participate in the new industry without any separate deliberation procedures, they will be able to strengthen competitiveness of the 4th industrial revolution."

In addition, he added, through a consortium between large companies with capital and business drive and small businesses with detailed technical skills, more efficient public SW projects can be carried out, and conditions will be created for shared growth with large and small companies.
